Glowly Terms

Glowly makes two iPhone apps. Choose yours:

These terms are an agreement between you and [OWNER: legal entity name] ("Glowly", "we", "us") for using the Glowly app and website. By using Glowly you agree to these terms and to our Privacy Policy. If you do not agree, do not use Glowly.

1. You must be 18 or older

Glowly is only for adults. By using it you confirm you are at least 18 years old and allowed to enter into this agreement where you live.

2. Your account

You can use the free profile score without signing up. Buying a photo pack requires Sign in with Apple. You are responsible for activity on your account and for keeping your device secure. You can delete your account at any time in Settings.

3. What Glowly does

Profile score (free). You upload screenshots of your own dating or social profile and get a score, suggested fixes and bio rewrites. The score reflects your profile, not your appearance, and is an opinion generated by AI.
Photo packs (paid). You take 4 selfies in the app, choose styles, and receive AI-generated photos based on your selfies.

Glowly is not affiliated with, endorsed by or sponsored by Tinder, Hinge, Bumble, Instagram or any other app. We do not promise any result, such as more matches or dates.

4. Your face only

You may only upload screenshots of your own profile and take selfies of yourself. You confirm that you are the person shown in your reference selfies and that you have the right to use every image you submit. Reference selfies must be taken with the in-app camera.

5. Things you may not do

You may not use Glowly to:

upload, capture or generate images of anyone other than yourself, including celebrities, public figures, friends, partners or strangers;
upload or attempt to create images of anyone under 18;
create or attempt to create nudity, sexual content, violent, hateful or otherwise harmful content;
impersonate anyone, create fake identities, or catfish, scam, harass or defraud others;
use generated photos in a way that breaks the law or the rules of the dating app or platform where you post them;
get around our safety checks, rate limits or the camera-only selfie rule, for example by photographing a screen or printed photo;
copy, scrape, reverse engineer, resell or access Glowly through automated means, or interfere with the service; or
use Glowly for any illegal purpose.

We may block content, remove photos, withhold credits used in breach of these terms, and suspend or close accounts that break these rules. We may report illegal content, including any content involving minors, to the authorities.

6. AI output

Glowly uses artificial intelligence. Scores, suggestions, bio rewrites and generated photos can be inaccurate, inconsistent or unexpected. Generated photos may not look exactly like you and can contain visual errors. Generated photos are AI-created images, not real photographs of events that happened. You are responsible for reviewing output before you use it and for disclosing that images are AI-generated where the law or a platform requires it. Glowly does not give professional, dating, psychological or other advice.

7. Your content and generated photos

You keep ownership of the screenshots and selfies you submit. You give us a limited, worldwide, non-exclusive, royalty-free license to process them, and to have our service providers process them, only to provide and protect Glowly, as described in the Privacy Policy. This license ends when the content is deleted.

As between you and us, we assign to you any rights we have in the photos generated for you, and you may use them for personal purposes, including on dating and social profiles. [OWNER: counsel to review ownership/assignment language for AI output and whether commercial use is permitted.] Generated photos are deleted from our servers after 30 days, so save the ones you want to keep.

8. Reports and moderation

We check images going in and photos coming out with automated safety tools. You can report or delete any photo in the app. Automated checks are not perfect, and we are not required to review all content, but we may review reported or flagged content and act on it.

9. Purchases, credits and refunds

Photo packs are one-time, consumable in-app purchases: 20 photos for $9.99 or 40 photos for $19.99 (US prices; local prices are set by the App Store). There is no subscription.
A purchase adds photo credits to your Apple-linked Glowly account. One credit creates one photo. Credits have no cash value, cannot be transferred and are only for use in Glowly. [OWNER: confirm whether credits expire; current design says they do not.]
If a photo fails to generate or is blocked by our safety checks, its credit is returned to your account.
All payments are processed by Apple under Apple's terms. Refund requests are handled by Apple at reportaproblem.apple.com. If Apple refunds a purchase, we remove the unused credits from that purchase.
Because packs are consumable, Restore Purchases does not re-download a past purchase. Your credits and photos are tied to your Glowly account; sign in with the same Apple ID to see them on a new device.

10. Our service and intellectual property

Glowly, including its app, design, styles, text and software, belongs to us and our licensors. We give you a personal, non-transferable, revocable license to use the app on Apple devices you own or control, under these terms and the App Store usage rules. We may change, suspend or stop any part of Glowly at any time.

11. Apple

These terms are between you and us, not Apple. Apple is not responsible for Glowly or its content, and has no obligation to provide maintenance or support. If the app fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any); Apple has no other warranty obligation. Apple is not responsible for claims relating to the app, including product liability, legal or regulatory compliance, consumer protection, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties.

12. Disclaimers

To the extent permitted by law, Glowly is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. [OWNER: counsel to review for consumer-law carve-outs in your markets.]

13. Limitation of liability

To the extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to Glowly is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. Nothing in these terms limits liability that cannot be limited by law. [OWNER: counsel to review.]

14. Indemnity

You agree to defend and indemnify us against claims arising from content you submit or your breach of these terms, including using images of another person, to the extent permitted by law.

15. Ending the agreement

You can stop using Glowly and delete your account at any time. We may suspend or end your access if you break these terms or if we stop offering Glowly. Sections that by their nature should survive, such as sections 6, 7, 12, 13, 14 and 16, survive termination.

16. Governing law and disputes

These terms are governed by the laws of [OWNER: jurisdiction], without regard to conflict-of-law rules. Disputes will be resolved in the courts of [OWNER: venue], unless the law where you live gives you the right to bring claims in your local courts. 17. Changes

We may update these terms. If changes are significant, we will tell you in the app before they apply. Continuing to use Glowly after that means you accept the updated terms.
